1. DEFINITIONS In these Terms and Conditions of Sale: “Company” means Prestige Timber Stables Ltd. “Purchaser” means the individual or entity placing the order. “Products” means the goods and/or services supplied by the Company. “Order” means the Purchaser’s acceptance of the Company’s quotation.
2. QUOTATIONS 2.1 All quotations issued by the Company are valid for four (4) weeks from the date of issue. 2.2 Quotations are provided on the assumption of reasonable access to the site for delivery and erection (see Clause 5).
3. PAYMENT TERMS 3.1 A deposit of fifty percent (50%) of the total purchase price is payable upon placement of the Order. 3.2 The remaining fifty percent (50%) balance is payable the day before delivery. All funds must be cleared prior to delivery/installation. 3.3 Failure to pay in accordance with Clause 3.2 may result in: a) A late payment surcharge of 10% being applied to the outstanding balance; or b) The delivery/installation team leaving the site with the Products. 3.4 Payment by cheque on delivery is not accepted.
4. CLERICAL ERRORS Any clerical or typographical errors, whether verbal or written, are subject to correction without liability on the part of the Company.
5. SITE ACCESS 5.1 The Purchaser shall ensure that the site is accessible and suitable for delivery and erection. 5.2 If access is restricted, the Purchaser shall provide assistance with unloading and transporting the Products to the site. 5.3 Additional charges may apply if reasonable access is not available.
6. CUSTOMER RESPONSIBILITIES 6.1 The Purchaser is responsible for all civil works, ground works, and brickwork. 6.2 For structures erected on a level earth site, the Purchaser shall stake down the Products. 6.3 In exposed locations, the Purchaser is responsible for taking adequate precautions to secure the Products against wind damage. 6.4 The Company accepts no liability for damage resulting from the Purchaser’s failure to secure the Products appropriately.6.5 The Purchaser is advised that field shelters, stables, and mobile buildings should not face South, South/West or West into prevailing winds unless adequate security measures are taken by the Purchaser.
7. DELIVERY 7.1 The Company shall provide delivery dates as accurately as possible. 7.2 Delivery may be delayed due to breakdowns, strikes, adverse weather, or other circumstances beyond the Company’s control. 7.3 The Company shall not be liable for any loss arising from delivery delays. 7.4 Customers must ensure that all materials/buildings delivered to the site are adequately covered by insurance against fire, theft, extreme weather conditions, acts of god or other loss or damage. 7.5 When constructing a mobile unit if Prestige Timber Stables Ltd cannot access the desired location or if that location is not suitable for construction, we will construct in a nearby location in agreement with you.
8. TRANSIT DAMAGE 8.1 The Purchaser must inspect the Products immediately upon delivery. 8.2 Any damage must be documented, reported immediately by email before the delivery team leave site.
9. TIMBER DISCLAIMER AND MAINTENANCE 9.1 All timber is inspected at manufacture. 9.2 The Company shall not be liable for timber shrinkage, expansion, cracking, warping, or other natural movement. 9.3 The Purchaser is responsible for the ongoing maintenance of timber structures, including treatment at least once annually (or more frequently in exposed locations). 9.4 The Company is not obliged to return to site to adjust for timber movement caused by weather conditions. 9.5 When the external frame is bolted together, there may be a slight discrepancy where the sliplap cladding does not line up exactly. This is normal and does not effect the integrity of the building. The panels are made individually in our workshop and we cannot foresee this nor adjust on site. The buildings are made from timber which is a natural product and although treated the timber is not waterproof or fire retardant. If required we can provide you with details of a supplier of coatings and paints to suit your needs.
10. RETENTION OF TITLE 10.1 Title to the Products shall not pass to the Purchaser until the Company has received payment in full. 10.2 In the event of non-payment, the Purchaser grants the Company an irrevocable licence to enter the premises to remove the Products.
11. DELIVERY VEHICLE ACCESS 11.1 The Company’s assembly service assumes that its delivery vehicle (4x4 with 16-18ft trailer) can access the site on a reasonable surface. To avoid additional charges please ensure that the site allows safe access e.g. a hardcore track or a tractor/ other suitable vehicle is available to tow the delivery vehicle into and out of the site. Due to health and safety regulations, we can only carry buildings a short distance of no more than 15m.11.2 If access is not possible, or we are unable to construct your building on your agreed installation date due to the poor quality of the base, or if we need to extend the installation time or attend on an alternate date, a charge will be incurred. Likewise if there are any discrepancies with the concrete pad or brick course and we are not able to construct your building on the planned date a charge will be incurred.
12. CANCELLATION OF ORDERS 12.1 Order cancellations will be reviewed on a case-by-case basis. 12.2 Consideration will be given to: a) The date of cancellation; b) Monies already paid and received; c) Materials already ordered; d) Whether construction has commenced; e) Applicable administration fees.
13. ACCEPTANCE OF TERMS By placing an Order, the Purchaser acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions of Sale.
14. GOVERNING LAW These Terms and Conditions shall be governed by and construed in accordance with the laws of England, and the parties submit to the exclusive jurisdiction of the courts of England.
